Texas decides injury claims by who caused the crash, not by who had a license or insurance, and Texas has no law that bars uninsured drivers from recovering. Driving without a license or insurance can bring tickets, but that is separate from your right to be paid for your injuries.

Fault decides the claim
Texas decides injury claims by how the crash happened. If the other driver ran a red light, turned in front of you or hit you from behind, they are responsible for it, whether or not you had a Texas license. A missing license does not make you the cause of a crash you did not cause.
Texas uses proportionate responsibility: you can recover as long as you were not more than 50% at fault, reduced by your share. Expect the other side to bring up the missing license anyway. What matters is the evidence of how the crash happened, and that is what we build.
No insurance? Texas has no “no pay, no play” rule
Some states limit what an uninsured driver can recover, especially for pain and suffering. Texas is not one of them. If another driver caused the crash, you can claim your medical bills, lost wages, pain and the damage to your car, even though you had no insurance.
What it does affect
Driving without a license or without insurance can bring tickets and fines. That is separate from your injury claim. Without your own policy, there is no coverage of your own to fall back on, so the claim goes against the other driver's insurance. And if a crash is your fault, the other people hurt can come after you personally, so it is worth getting coverage going forward.
Does a license from my country count?
A valid license from another country can let a visitor drive in Texas for a limited time, generally up to one year after entering the United States. Once someone lives in Texas, the state requires a Texas license within 90 days. Either way, a foreign license is still identification, and it does not decide who caused the crash.
Can I still get my car fixed?
Yes. The damage to your car is part of the claim against the at-fault driver's insurance, whether or not you had a license or insurance. Take photos before any repairs and keep every estimate. Tow yard storage fees add up by the day, so tell us right away where the car is.
If the other driver has no insurance either
We look for every policy that applies: the car you were riding in, if you were a passenger; the other driver's employer, if they were working; and the owner of the car, if someone else owned it. A hit-and-run or an uninsured driver is not always a dead end.
Bring whatever ID you have
A license from your home country, a passport or a consular ID still identifies you. Keep any ticket you were given and photos of the cars. Your immigration status does not decide this claim either; here is why. They may try, or offer less, hoping you won't push back. A missing license is not a legal reason to deny a claim when their driver caused the crash, and that is exactly the kind of argument we handle.
Can I get a ticket for driving without a license after a crash?
It's possible. Driving without a license or without insurance is a separate traffic offense, and an officer at the scene can write a ticket. A ticket does not affect your right to be paid for injuries someone else caused.
I was a passenger and our driver had no license. Can I still claim?
