Why a passenger claim is usually the strongest one in the wreck

Texas reduces an injured person's recovery by their percentage of responsibility and bars it entirely above 50 percent. A passenger almost never has a percentage. You were not steering, not braking, not choosing the following distance. The argument that normally consumes a car wreck claim — who caused it — usually cannot be aimed at you at all.

That has a practical consequence: the drivers may spend months blaming each other, and it frequently does not matter to you which one wins. If either was negligent, you have a claim against that one. If both were, you have claims against both.

The exceptions, stated honestly

"Almost never" is not "never," and you should know where the edges are.

Seat belts. Texas changed this in 2015. Evidence that you were not wearing one is admissible and can reduce your recovery to the extent it contributed to your injuries. It does not defeat the claim.

Knowingly riding with an impaired driver. If you knew the driver was intoxicated and got in anyway, expect that argument.

Interfering with the driver. Rare, and it takes real facts.

Nothing else about being a passenger creates fault. Not sitting in the back, not being asleep, not having suggested the trip.

Count the policies — there are usually more than one

This is where passenger claims are won or lost, and where people leave money behind.

Each at-fault driver's liability policy. If two drivers share blame, both policies are available to you.

The host driver's PIP. PIP typically covers passengers in the insured vehicle, pays regardless of fault, and is not reduced because other coverage paid. It is usually the fastest money available and, in the ordinary case, is not paid back out of your settlement.

Your own UM/UIM. People miss this constantly. Depending on your policy language, uninsured and underinsured motorist coverage on your auto policy can follow you as a passenger in someone else's vehicle — and a resident relative's policy may reach you as well. If the at-fault driver carried Texas minimum limits of $30,000 per person, your own UM/UIM is often the difference between a partial recovery and a full one.

Commercial and rideshare coverage. If the vehicle was a work truck, a company car, a rideshare in an active trip, or a commercial passenger vehicle, larger layered policies apply and the analysis changes entirely.

The limits problem nobody warns passengers about

Texas minimum coverage is $30,000 per person and $60,000 per crash. That second number is the trap. Four injured people sharing one $60,000 policy are not each getting $30,000 — they are dividing $60,000, and a carrier facing multiple claimants may move quickly to pay out and close.

If several people were hurt in your vehicle, timing and your own UM/UIM coverage matter far more than they would in a two-car, one-injury wreck. This is a situation where waiting is expensive.

If the driver was your friend, your spouse, your parent

The most common reason passengers do not make a claim is that they do not want to sue someone they love. The claim is against the policy. The insurer receives it, the insurer hires and pays the defense lawyer, the insurer negotiates, the insurer writes the check. Your friend pays nothing out of pocket unless the damages exceed the limits, and they are not the one handling it.

The alternative is absorbing the medical bills yourself — debt that the friendship never asked you to carry, and that the premiums were paid to prevent. We have had this conversation many times. It is almost always less awkward than people expect, and it is worth having before the bills go to collections.
