Two cities, two sets of rules

A crash in Pasadena is worked by the Pasadena Police Department, and a crash in Baytown by the Baytown Police Department — not the Houston Police. Each city also sets its own rules for claims against it, such as a crash with a city truck or an injury caused by a dangerous condition the city maintains.

Baytown’s are unusually strict. Its city charter requires written notice to the city manager within 30 days of the incident — describing the injury, when, where and how it happened, the damages sought and the witnesses — and no lawsuit can be filed until 60 days after that notice. Pasadena sets its own requirement. State law sets a six-month default but lets a city set its own, often shorter, deadline by charter or ordinance, which is why the deadline has to be checked city by city, and why the City of Houston’s 90-day rule is the wrong answer here.

Baytown sits in two counties

Most of Baytown is in Harris County, but the city also extends into Chambers County. Which side a crash happened on can decide which county’s courts hear the case and which agencies respond on the highways. It is one more detail to get right at the start rather than discover later.

The plants

This stretch of the Ship Channel is lined with refineries and chemical plants. ExxonMobil describes its Baytown complex as one of the largest integrated refining and petrochemical complexes in the world, on about 3,400 acres. Pasadena’s economy is built on the same industry. Plant injuries raise questions that road crashes do not: whether your employer carries workers’ compensation, whether the plant owner or another contractor on the site is responsible, and whether equipment failed. If your employer does not carry workers’ compensation, you may be able to sue it directly, and it loses key defenses.

Plant and port traffic on the roads

SH 225, SH 146, Beltway 8 and I-10 carry tankers, flatbeds and container trucks serving the plants and the port. The Fred Hartman Bridge carries SH 146 between La Porte and Baytown. A crash with a commercial truck is governed by federal motor carrier rules, and one hauling fuel or chemicals is held to additional rules and must carry more insurance. In 2024, TxDOT counted 1,859 crashes inside Baytown’s city limits, and eight people were killed.
